Terms and Conditions


The e-shop tiigikalad.ee  belongs to Smartfish OÜ (registry code 14364154), located at Audova, Muri village, Luunja municipality, Tartu County, 62208.

 

1. Terms of Sale


1.1 These terms apply to purchases of goods and services from the online store tiigikalad.ee operated by Smartfish OÜ (hereinafter referred to as the seller).

1.2 In addition to these terms, legal relationships arising from purchases made in the online store are governed by the Consumer Protection Act, the Law of Obligations Act of the Republic of Estonia, and other applicable legislation.

1.3 Product images in the online store are illustrative and may differ slightly from the actual product.

1.4 Smartfish OÜ reserves the right to withdraw from the sales agreement made via the online store and not deliver the ordered goods if the product is out of stock or if the price or characteristics of the product have been displayed incorrectly due to a system error. If the seller is unable to fulfill the order, the customer will be notified and the amount paid will be refunded within 14 days at the latest.

1.5 The seller reserves the right to make changes to the terms of sale without prior notice.

1.6 Product descriptions in the online store may contain unintentional errors.

1.7 Product prices are listed next to each item and are displayed in euros. Delivery charges will be added to the price of the goods.

 

2. Placing an Order


2.1 Select the desired product and add it to your shopping cart.

2.2 To place an order, go to the shopping cart, choose a delivery method, and enter the destination/desired parcel machine (except if you selected “Pick up in person”).

2.3 After selecting the delivery method, fill in the required fields.

2.4 After entering your information, choose a payment method and click “Place Order.”

2.5 Once the transaction is confirmed, an order confirmation will be sent to the email address provided during checkout.

2.6 If the ordered product is out of stock or cannot be delivered for any reason, the buyer will be notified as soon as possible and the full amount paid will be refunded promptly, but no later than 14 days from the date of order.

 

3. Delivery of Goods


3.1 After the sales agreement takes effect, the customer can receive the ordered goods using the delivery method selected during checkout:

3.1.1 If the customer selected “fish courier,” the seller will deliver the goods within 14 working days (excluding islands) from the order confirmation.


3.1.2 Goods ordered to a parcel machine will be dispatched within 14 working days after order confirmation.


3.1.3 Goods can also be picked up in person at an agreed time at: Audova, Muri village, Luunja municipality, Tartu County, 62208.


3.2 The seller reserves the right to deliver the goods within up to 45 calendar days in exceptional cases.

3.3 If the goods are found to be defective or damaged during delivery, the seller must be notified immediately and, if possible, photos of the damaged goods should be provided.

3.4 The seller is not responsible for delivery delays caused by circumstances beyond their control or unforeseeable events.

3.5 The buyer is responsible for shipping costs, which will be displayed during checkout.

3.6 The buyer is responsible for providing accurate delivery and contact information. If incorrect information is provided and the package is returned, the standard shipping fee will apply for resending.

 

4. Right of Withdrawal


4.1 After receiving the order, the buyer has the right to withdraw from the contract within 14 days. The right of withdrawal does not apply to legal entities.

4.2 The right of withdrawal does not apply to live goods such as fish, water lilies, etc.

4.3 To return goods, a written request must be submitted and sent to info@tiigikalad.ee within 14 days of receiving the goods.

4.4 To exercise the 14-day right of withdrawal, the goods must not be used in any way other than necessary to determine their nature, characteristics, and functioning as would be allowed in a physical store. If the goods have been used for other purposes or show signs of wear, the seller has the right to reduce the refund amount accordingly.

4.5 The seller does not reimburse return shipping costs unless the return is due to the product being incorrect or defective.

4.6 The buyer must return the goods within 14 days of submitting the withdrawal request or provide proof that the goods were handed over to the shipping company within that time.

4.7 Upon receiving the returned goods, the online store will refund the buyer without delay, but no later than 14 days from receiving the withdrawal notice.

4.8 The online store may withhold the refund until the returned item is received or the buyer provides proof of return, whichever comes first.

4.9 Smartfish OÜ has the right to cancel the sales transaction and request the return of goods if the product price was significantly lower than the market price due to an error.

 

5. Complaints Procedure


5.1 Smartfish OÜ is responsible for any non-conformity or defects in the goods that existed at the time of delivery or become apparent within 2 years. For legal entities, the manufacturer’s warranty period applies.

5.2 The buyer must notify the seller of any defects within two months of discovering them by emailing info@tiigikalad.ee. Failure to do so releases Smartfish OÜ from liability.

5.3 For live goods (e.g., fish, water lilies), complaints must be submitted before the buyer takes physical possession of the goods.

5.4 If a product purchased from tiigikalad.ee is found to be defective and the online store is responsible, the product will be repaired or replaced. If repair or replacement is not possible, the seller will refund all related costs.

5.5 Smartfish OÜ is not responsible for defects caused by improper use or storage by the buyer.

5.6 All complaints will be reviewed and responded to as soon as possible, but no later than 15 days after receipt.

 

6. Processing of Personal Data


6.1 The online store uses the buyer’s personal data only for processing the order and delivering the goods. Necessary data will be shared with the delivery service provider solely for the purpose of delivery.

6.2 Smartfish OÜ has the right to use the buyer’s contact details to send important information.

 

7. Dispute Resolution


7.1 All complaints must be submitted via email to info@tiigikalad.ee or by calling +372 5806 5035. If the seller and buyer cannot resolve the dispute, the buyer has the right to contact the Consumer Disputes Committee.
